The petitioners seek pre-arrest bail in connection with Ara Muffasil P.S. Case No. 179 of 2019, registered under Sections 341, 323, 504, 349, 307 and 34 of the Indian Penal Code.

The accusation is that in the evening of 23.06.2019, four persons, named in the first information report, including the petitioners, started to abuse the informant, Sanjay Kumar Yadav. When, the nephew and mother of the informant made protest, both the petitioners caused injury to them, who sustained injuries at their head. At that time, they snatched the gold chain

Patna High Court CR. MISC. No.67068 of 2019(3) dt.06-02-2020 2/2 from the neck of his nephew.

Submission is that due to neighbour dispute hot talk exchanged between the parties and with ulterior motive the present case has been lodged with allegation of snatching the gold chain and ornaments also. More over, injuries found on both the injured, are simple in nature.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Ara Muffasil P.S. Case No. 179 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
