ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.09.2019 on his surrender in connection with Barauni (Refinery O.P.) P.S. Case No.290 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but only because the vehicle in question was in his name, he has been implicated in connection with the present case. It is further submitted that save and except one case under the E.C. Act of the year 2012, the petitioner has no other criminal antecedents.

Considering the aforementioned facts and

No.62361 of 2019(2) dt.14-10-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II Cum Special Judge, Excise Act, Begusarai, in connection with Barauni (Refinery O.P.) P.S. Case No.290 of 2019.
