Petitioner apprehends his arrest in a case registered for the offence punishable under Section 341, 323, 324, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
Informant who is ward member has alleged in her written complaint that Mukhiya called her along with her husband to sign a cheque of Rs. 5 Lacs, then her husband said that earlier Rs. 7 Lacs was withdrawn for panchayat work which has not been executed and now another cheque of Rs.5 Lacs will not be issued, on account of which FIR named accused started assaulting her husband and petitioner fired upon her husband by 3 Knot Gun and thereafter he was taken away in a BOLERO

Considering the fact that there is direct allegation of firing upon the petitioner and in the injury report the Doctor has found fire arm injury on the forearm of the victim, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
However, it is observed that if petitioner surrenders before the court below and prays for regular bail, his application for regular bail will be considered and disposed of preferably on the same day, without being prejudiced by this order. (S. Kumar, J) ranjan/- U
