2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 323, 325, 307, 379 504 and 506 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner along with others were harvesting the wheat crop of the informant when the informant reached there and stopped from harvesting. It is further alleged that the petitioner along with other assaulted the informant and others.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. The specific allegation against this petitioner is that he assaulted Fakir Alam with

Patna High Court CR. MISC. No.72581 of 2024(2) dt.08-10-2024 2/2 'lathi' indiscriminately. However, it is not clear from the FIR as to which part of the body was injured by the petitioner. The allegation regarding assault is not specific. It is further submitted by the learned counsel for the petitioner that there is also a counter version of the case and the petitioner is having no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 31.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jamalpur P.S. Case No. 36 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga.
