JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2018 Learned counsel for the petitioners informs the court that during the pendency of this application, the petitioner no.8 Rintu Singh @ Rintu Kumar was arrested by the police and as such the application for anticipatory bail on behalf of the petitioner no.8 has now become infructuous.

Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are apprehending arrest in connection with

Patna High Court Cr.Misc. No.7327 of 2018(2) dt.17-02-2018 2/2 Darihat P.S. Case No. 101 of 2017 for the offence under sections 147, 148, 149, 186, 341, 323, 504, 506, 337, 338, 322, 427, 333, 307, 120(B), 353 of the Indian Penal Code.

The name of the petitioners surfaced on the statement of Chouwkidar that they were involved in illegal mining. From perusal of the FIR, it appears that Chouwkidar has named 35 persons. In addition thereto he has mentioned about the involvement of 34 unknown.

In view of the fact that omnibus allegation has been levelled against the petitioners, the court is inclined to grant anticipatory bail to the petitioners named above in the event of arrest/surrender before the court below within a period of one month on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Darihat P.S. Case No. 101 of 2017on the condition that the bailors should be family members of the petitioners and other conditions as laid down under section 438(2) of the Cr.P.C.
