2. The petitioners apprehend their arrest in connection with Sohsarai P.S. Case No. 157 of 2024, instituted under Sections 420, 406 of the Indian Penal Code.

3. As per the prosecution case, informant had given total Rs. 4,70,000/- to co-accused Prem Prakash Kumar for repairing and coloring his house but the work was not done. Petitioners are alleged to be associates of co-accused Prem Prakash Kumar. Petitioners and co-accused Prem Prakash Kumar are full brothers.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.72838 of 2024(2) dt.23-10-2024 2/2 petitioners are innocent and have falsely been implicated in this case. No amount has been given to the petitioners. Petitioners have no concern with the transaction between the co-accused and the informant. Petitioners have no criminal antecedent. They undertake to co-operate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Sohsarai P.S. Case No. 157 of 2024, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
