JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392 and 394 of the Indian Penal Code.

Petitioner is named in the first information report but perusal of first information report goes to show that the informant came to learn the name of the petitioner on the basis of conversations of the culprits. Moreover, nothing has been recovered from the conscious possession of the petitioner, who is languishing in jail custody since 29.07.2019 and having more or less similar allegation, co-accused Dilip Yadav @ Madhu Yadav has already been granted privilege of bail by co-ordinate

Patna High Court CR. MISC. No.67095 of 2019(2) dt.04-11-2019 2/2 bench of this court, vide order, dated 15.10.2019, passed in Cr. Misc. No. 60278 of 2019, accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Gaya in connection with Jehanabad Rail P. S. Case No. 44 of 2018.
