The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 372 of 2019 registered under Sections 341, 323, 325, 498A and 509/34 of the Indian Penal Code.
Submission of learned counsel for the petitioner is that earlier prayer of the petitioner for grant of anticipatory bail was rejected by this Court vide order dated 28.10.2021 passed in Cr. Misc. No. 660 of 2021. Petitioner has no criminal antecedent.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.67546 of 2022(6) dt.18-01-2023 2/2 opposite parties opposed the prayer of the petitioner by contending that earlier prayer of the petitioner for grant of anticipatory bail was rejected on merit on 28.10.2021 passed in Cr. Misc. No. 660 of 2021. Now, there is no fresh ground in the present case. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.
Having considered the facts and circumstances of the case as well as the submissions advanced on behalf of the State, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) shailendra/- U T
