The petitioner apprehends his arrest in connection with Desari P.S. Case no. 177 of 2019, registered under Section 323, 324, 379, 307 and 504/34 of the Indian Penal Code. The accusation is that eight persons named in the F.I.R. including the petitioner, started to abuse the informant Debanti Devi, when she made protest then petitioner gave sword blow at her head. When Sunil Kumar, son of informant, rushed to save her then he was also assaulted by them. At that time, Upesh Paswan snatched gold locket of son of informant worth of Rs. 10,000/-.
Learned counsel for the petitioner submits that occurrence of Marpit took place due to land dispute. Moreover,
Patna High Court CR. MISC. No.62243 of 2019(2) dt.21-10-2019 2/2 the injuries as found on the person of informant are simple in nature. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Vaishali at Hajipur in connection with Desari P.S. Case No. 177 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
