It appears that the anticipatory bail application of this petitioner was earlier rejected on 07.07.2017 as per passed in Cr.Misc.No.30969 of 2017 considering the fact that the victim had supported the case of abduction by this petitioner. As per date of birth given in matriculation certificate, the victim has been found minor.

It has been submitted that the victim has been ordered to be released from the after care-home and was permitted to go at the place of this petitioner considering her marriage with the petitioner and also her pregnancy.

Since prayer for anticipatory bail of this petitioner has been rejected considering the age of victim, I am not inclined to reconsider his similar prayer. The petitioner, however, if

Patna High Court Cr.Misc. No.1930 of 2018 (2) dt.10-01-2018 2/2 surrenders before the court below and prays for regular bail, his prayer for bail will be considered on its own merit without being prejudiced by this order.
