2. The learned counsel for the petitioner has submitted that though the regular bail petition of the petitioner was rejected by this Court vide order dated 14.03.2023 in Cr. Misc. No. 69249 of 2022 but the fresh ground for filing of the bail petition is that co-accused Vicky Kumar, who is on similar footing, has been granted regular bail by the coordinate Bench of this Court vide order dated 01.09.2023 in Cr. Misc. No. 42770 of 2023 on the ground of incarceration as well as delay in disposal of the trial.

3. A report was called for from the learned trial court which has been received. It appears from perusal of the report

Patna High Court CR. MISC. No.71181 of 2023(3) dt.01-12-2023 2/2 that charges were framed in this case on 13.04.2023 but not a single witness has been examined as yet.

Considering the above-mentioned facts and circumstances especially the fact that co-accused Vicky Kumar has been granted bail by the coordinate Bench of this Court, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XXVII, Patna in connection with Parsa Bazar P.S. Case No. 328 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial.

(ii) If the petitioner fails to appear on two consecutive dates without any valid reason, the learned court below will be at liberty to cancel the bail bond of the petitioner.
