Petitioner, already in custody, seeks bail in Khizersarai PS Case No. 135 of 2016, registered under Sections 409 and 420 of the IPC.

The allegation in brief is that the petitioner, Headmistress of the School, was allotted seven lakh seventy thousand rupees for construction of school building under Sarb Shiksha School, but she did construction work worth five lakh nine-two thousand rupees, did not complete the protect and misappropriated the rest amount. Submission is that the petitioner later on completed the project as the same is reflected from the statement of the Junior Engineer contained in para 62 of the case diary and the petitioner is in custody since 23.12.2017.

Having considered the said facts and circumstances, the petitioner Urmila Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Gaya in connection with Khizersarai PS Case No. 135 of 2016.
