JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 30.3.2017 passed in Cr.Misc.No.14550 of 2017 with direction to learned trial court to expedite the trial and conclude it within a period of nine months and liberty was given to the petitioner to renew his prayer for bail if the trial is not concluded.
Submission of learned counsel for the petitioner is that petitioner is in custody since 16.2.2017 and trial has not been concluded as yet.
Heard learned APP also.
Having heard both sides and on perusal of report it appears that learned trial court has assured to conclude the trial within a further period of three months, I am not inclined to grant
Patna High Court Cr.Misc. No.6983 of 2018 (3) dt.21-03-2018 2/2 bail to the petitioner.
However, learned trial court is directed to conclude the trial within a further period of two months. At the same time, Superintendent of Police, Samastipur is directed to ensure the presence of the witnesses in court so that the trial may be concluded within the said period.
