Mr. Sri Nagendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-04-2018 Heard learned counsel for the petitioners and the learned APP for the State.

Petitioners, already in custody, seek bail in connection with Mohania P.S. Case No.417 of 2016, registered under Sections 302 and 201 of the Indian Penal Code. Allegation in brief is that a dead body of a woman was found and during investigation it is suspected that the petitioners, father and brother of the deceased, have killed the lady as she married against their wish.

Learned counsel for the petitioners submits that except suspicion raised against the petitioners, there is no other material against them in the case diary; whereas the learned counsel for the State refers paragraph nos.48 and 49 of the case

Patna High Court Cr.Misc. No.10356 of 2018(5) dt.10-04-2018 2/2 diary and concedes that there is no other direct evidence against the petitioners.

Having considered the aforesaid facts and circumstances, petitioners Tej Narayan Singh and Sureman Singh are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Mohania P.S. Case No.417 of 2016 with conditions that one of the bailors must be the close family member of the petitioners and the petitioners shall remain physically present on each and every date before the trial court and if they absent themselves on two consecutive dates without any reasonable cause, their bail bonds shall liable to be cancelled.
