2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 317(4), 317 (5), 336 (3) of the BNS.

3. The case of the prosecution is that the police received information that one person was standing near a betel shop at Yadav Chauk with a stolen splendor motorcycle and was trying to sell the same. Acting upon the said information, the police party proceeded to the place of occurrence to verify the information and take necessary action. Upon reaching near the betel shop at Yadav Chauk, the petitioner allegedly started his motorcycle and tried to flee, but he was apprehended on the spot. Hence the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing incriminating has been recovered from his conscious possession. He was arrested by the police on 26.09.2024 but was remanded on 28.09.2024 i.e. after 48 hours of his arrest and was kept in 'Hazat' without any lawful authorization. It is further submitted that the petitioner has been framed in this case as he is having criminal antecedents of eight cases. Moreover, the petitioner is languishing in judicial custody since 28.09.2024. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Saharsa Sadar P.S. Case No. 1023 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
