JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sasaram (Tilauthu) P.S.Case No. 1844 of 2017 registered under Sections 379, 420 and 411 of the Indian penal Code. Allegation in brief is that informant operated ATM for withdrawal of 18000/- cash but after transaction he could not get money. The petitioner standing behind asked him to leave and operated ATM. Informant received message on his mobile of withdrawal of money and suspected petitioner trying to escape away but apprehended and Rs. 15,000/- was recovered from his pocket.

Submission is that petitioner withdrew Rs. 15,000/- by using his own ATM and only that amount was recovered and not

Having considered the aforesaid facts and circumstances, the petitioner, namely, Pradeep Chaudhary, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas at Sararam in connection with Sasaram (Tilauthu) P.S. Case No. 1844 of 2017.
