JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 312C of 2017, disclosing offences under Sections 323, 447, 504, 406 of the Indian Penal Code.

As per complaint case, there is allegation of taking loan of Rs. 1,50,000/- from the complainant and when he demanded the same, the complainant was assaulted by the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner is Bataidar of the complainant and due to that Bataidar the dispute arise between them. There is no chit of paper to support the loan of Rs.1,50,000/-.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-1st, Khagaria, in connection with Complaint Case No. 312C of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
