2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8 (c), 18 (c), 21 (c) and 29/31 of the NDPS and Section 111 of the BNS.
3. The case of the prosecution is that altogether 1026.68 grams of heroin was recovered from the possession of co-accused, namely, Baliram Chaurasiya.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. It is further submitted that name of the petitioner has surfaced only in the statement of Baliram Chaurasiya, who has alleged that the petitioner and others are his associates and that he had relations with them in connection with the
Patna High Court CR. MISC. No.67450 of 2025(2) dt.17-09-2025 2/2 transportation of contraband articles. It is further submitted that though the petitioner has criminal antecedent of three cases of a similar nature, but nothing has been recovered from his possession in the present case. It is further submitted that save and except the confessional statement of co-accused, Baliram Chaurasiya, no other material has come on record to implicate the petitioner. Moreover the petitioner has been languishing in judicial custody since 04.07.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has six criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kishanganj P.S. Case No. 343 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge (NDPS Act), Kishanganj.
