ANJANA MISHRA ORAL ORDER 27-02-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 15.12.2017 in connection with Bihta P.S. Case No.988 of 2017 registered for the offences under Section 386 of the Indian Penal Code. The allegation against the petitioners is that they had demanded Rangdari by sending WhatApp call to the informant. However, it is submitted that the said WhatApp number does not belong to the petitioners nor has any money exchanged hands between the informant and themselves. It is only on suspicion, that the petitioners were taken into custody and illegally detained for four days and thereafter produced before
Patna High Court Cr.Misc. No.9186 of 2018 (3) dt.27-02-2018 2/2 the Magistrate. Learned counsel further submits that the petitioners have got no criminal antecedents. Considering the aforementioned facts and circumstances and that no further material has surfaced in the case diary, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Bihta P.S. Case No.988 of 2017.
