JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.2.2018, seeks bail in Narpatganj PS Case No. 77 of 2000 registered under Sections 304(B), 201 and 34 of the IPC.
The allegation in brief against the petitioner is that he helped the accused persons in disposing of the dead body of the deceased. Learned Counsel for the petitioner seeks bail of the petitioner on the ground of parity as Md. Naimul having similar accusation was earlier admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 23061 of 2017. It is also submitted that the petitioner is not the family member of in-laws of the deceased. Having considered the said facts and circumstances, the petitioner, namely, Sekh Israr is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM III, Araria in connection with Narpatganj PS Case No. 77 of 2000.
