The petitioner seeks bail in connection with Daraunda P.S. Case No. 135 of 2016 registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.

Informant in his written complaint has stated that he is a shopkeeper and in the night of 5/06.09.2016, he was sleeping in front of his shop and at about 12 O' Clock in the night it started raining and thereafter he went to sleep in the hotel nearby and slept there. In the morning, when he came to his shop he found that the lock was broken and when he entered the shop he found 9 SIM Cards and Rs. 30000/- cash were stolen by the miscreants and an FIR was registered against unknown.

Patna High Court Cr.Misc. No.6092 of 2018(3) dt.27-02-2018 2/2 The petitioner was arrested and theft articles were recovered from his conscious possession, when he was searched by the police on Daraunda Railway Platform No. 1 and has confessed his guilt.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case, and nothing has been recovered from his possession and is in custody since 30.10.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Siwan in connection with Daraunda P.S. Case No. 135 of 2016. (S. Kumar, J) ranjan/- U
