The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/411/413/414 of the Indian Penal Code and section 11 of the Animal Cruelty Act, 1960.
Prosecution case is that police stopped a truck carrying cattle to which its driver did not produce any paper. Petitioner is said to be owner of the said truck. Learned counsel for the petitioner submits that petitioner's name has come during investigation in confessional statement of the driver of the truck. Petitioner is merely owner of the said truck which was a commercial vehicle and he was not aware of consignment which was being transported by
Patna High Court CR. MISC. No.67948 of 2022(2) dt.04-04-2023 2/2 this vehicle. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IV cum SJ XII, Rohtas at Sasaram in Chenari Police Station Case No. 226 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
