02. In the present case, the petitioner seeks bail in connection with Bikramganj P.S. Case No. 186 of 2025 registered for the alleged offences Sections 30(a), 62 of the Bihar Prohibition & Excise Act, 2016.

03. As per prosecution case, on the basis of suspicion, a raid was conducted in the house of the petitioner and recovery of 65 liters of country made liquor was made. Further, 39 liters of raw material for making the liquor and 150 kg. dry Mahua were recovered and destroyed by the police party.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is the lady member of a joint family and

Patna High Court CR. MISC. No.69515 of 2025(2) dt.25-09-2025 2/3 recovery has been shown from the joint family house of the petitioner. The seizure list has not been prepared following the mandate of law. The petitioner is having clean antecedent and she is in custody since 08.08.2025.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that the petitioner is a lady and recovery has been shown from a joint house and further considering period of custody of the petitioner, she is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise)-I, Rohtas at Sasaram/court concerned in connection with Bikramganj P.S. Case No. 186 of 2025 (Excise Case No. 649 of 2025), subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be the close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates

Patna High Court CR. MISC. No.69515 of 2025(2) dt.25-09-2025 3/3 or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
