The petitioner is in custody in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

Allegedly, it is a case of recovery and selling of illicit liquor at the South Nala Chat of Rauja Road Mohalla in Khatal Bangal of Chakul Paswan near Badsahi Toli.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody since 17.09.2022 and petitioner has clean

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.II-cum-Additional District & Sessions Judge, Rohtas at Sasaram in connection with Sasaram Town (Darigaon) P.S. Case No. 804 of 2022.
