The learned counsel for the petitioner very fairly submits that during the pendency of the present quashing application, the matter was investigated, charge-sheet has been submitted and cognizance also has been taken, as such, the quashing application for the present has become infructuous, thus seeks permission to withdraw the quashing application with a liberty to file a fresh quashing application challenging the order taking cognizance. Permission is accorded.

Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
