JUSTICE ARUN KUMAR ORAL ORDER 19-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.3.2018, seeks bail in Bhagwan Bazar PS Case No. 3 of 2017 registered under Sections 406, 409, 420, 467, 468, 471, 506 and 34 of the IPC. The allegation in brief is that the informant made some investment as partner in the business of the petitioner who is distant relative but profit was not properly shared by him and he misappropriated his proportion of profit of the business transaction.

Learned Counsel for the petitioner submits that petitioner and informant both had made investment in the business, they shared the profit and the allegation that principal amount was not returned is not correct, this petitioner has clean antecedent. Having considered the said facts and circumstances as the dispute primarily appears to be civil in nature so the petitioner, namely, Abhishek Pandey @ Abhishekh Pandey is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Saran at Chapra in connection with Bhagwan Bazar PS Case No. 3 of 2017.
