JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barachatti (Mohanpur) P.S.Case No. 02 of 2016 registered under Sections 120B, 147, 302 and 379 of the Indian penal Code. Allegation in brief is that while the informant's son and accused persons were celebrating new year day dancing to the tune of DJ, they pushed his son into a well, as a result of which he died.

Submission is that there is no any specific allegation against the petitioner that who had pushed him into the well and similarly situated co-accused Punjabi Mandal @ Punjabi Manjhi and others have been admitted to bail by a co-ordinate Bench of this Court vide order dated 11.05.2016 passed in Cr. Misc. No. 19721 of 2016 and the case of the petitioner stands on similar footing.

No.12273 of 2018 (2) dt.28-02-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Manoj Mandal @ Manoj Manjhi, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S.
