JUSTICE ARUN KUMAR ORAL ORDER 16-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.11.2017, seeks bail in Manjhagarh PS Case No. 84 of 2017 registered under Sections 366A/34 of the IPC.
The allegation in brief is that the informant's daughter went to coaching institute but thereafter she did not return back and it is suspected that the petitioner has enticed her away for the purpose of marriage.
Learned Counsel for the petitioner submits that it is a case of elopement, though the girl in her statement has leveled allegation of kidnapping but during her period of stay in Delhi she never made any complaint to anybody and the girl is major as her age assessed by the Medical Board in between 17 - 18 years. Having considered the said facts and circumstances, the petitioner, namely, Govind Kumar Gond is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gopalganj in connection with Manjhagarh PS Case No. 84 of 2017.
