2. This application, for grant of anticipatory bail, arises out of Govindpur Police Station Case No. 281 of 2024, disclosing offences punishable under Sections 303(2), 317(2), 111(3) and 111(4) of B.N.S., 2023.

3. As per the prosecution-case, a tractor loaded with sand was abandoned by unknown persons upon seeing the raiding party. Sand was recovered from the said tractor. The name of the petitioner was disclosed by local residents.

4. Learned Counsel for the petitioner submits that

Patna High Court CR. MISC. No.68435 of 2025(2) dt.08-10-2025 2/3 the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He further submits that from the F.I.R. it is evident that no incriminating article has been recovered from his possession. Similarly situated person has been granted anticipatory bail by the co-ordinate Bench.

5. On the other hand, learned APP appearing for the State has opposed the prayer for anticipatory bail made on behalf of the petitioner.

Regard being had to the submissions advanced on behalf of the parties and taking into consideration the fact that similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court, as is evident from Annexure-P/2, I am inclined to grant the petitioner privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada, in connection with Govindpur Police Station Case No. 281 of
