2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 109 and 3(5) of B.N.S. and Section 27 of the Arms Act.
3. The case of the prosecution is that some unknown miscreants have fired at the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced in this case during investigation on the basis of CDR of one Manjeet Sharma. From the CDR of
Patna High Court CR. MISC. No.67411 of 2025(2) dt.17-09-2025 2/3 Manjeet Sharma, it was found that the petitioner had talked with him. It is alleged that Manjeet Sharma has planned the murder and has also given his confessional statement. Learned counsel for the petitioner has submitted that save and except, the call made by the petitioner to Manjeet Sharma, there is nothing against him. Learned counsel for the petitioner has also submitted that similarly situated other co-accused person has already been granted bail by learned co-ordinate Bench of this Court vide order dated 04.09.2025 passed in Cr. Misc. No. 41065 of 2025. The case of this petitioner stands on better footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 26.04.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Alinagar P.S. Case No. 76 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional
