The petitioner apprehends his arrest in connection with Barun P.S. Case No. 301 of 2022 registered under Sections 379 and 411 of the Indian Penal Code, Section 15 of the Environmental Protection Act, 1986 and Section 56(i) of the Bihar Mines Amendment Rules, 2021.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is the local resident of Balu Ghat hence, his complicity is only on the basis of suspicion, conjecture and surmises. Nothing has been recovered from the conscious possession of the petitioner.

No.66977 of 2022(4) dt.24-03-2023 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 301 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
