The petitioner-wife filed this petition for transfer of Divorce Case No.66 of 2017 from the Court of the learned Principal Judge, Family Court, Vaishali to the court of the learned Principal Judge, Family Court, East Champaran at Motihari. Learned counsel for the petitioner submits that the husband of the petitioner has already deserted her and she is living with her parents from the year 2015. The petitioner got difficulty in pursuing the case on each and every day after travelling a long distance from East Champaran, Motihari to Hajipur, Vaishali. Learned counsel for the opposite party submits that the petitioner appeared and filed her WS. Evidences were also adduced and she filed this petition at the very belated stage. Having considered the submissions of both sides and
Patna High Court MJC No.3175 of 2017(4) dt.25-02-2020 2/2 taking into consideration the difficulties faced by the lady petitioner in pursuing the case on each and every day after travelling a long distance from East Champaran, Motihari to Vaishali, Divorce Case No.66 of 2017 is ordered to be transferred from the court of the learned Principal Judge, Family Court, Vaishali, Hajipur to the court of the learned Principal Judge, Family Court, East Champaran, Motihari. The learned Principal Judge, Family Court, Hajipur, Vaishali is directed to transmit all the records of Divorce Case No.66 of 2017 to the court of the learned Principal Judge, Family Court, East Champaran, Motihari within four weeks from the date of receipt of this order. The M.J.C. petition is allowed accordingly.
The learned Principal Judge, Family Court, East Champaran, Motihari shall strive to dispose of the case preferably within nine months.
