ANJANA MISHRA ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 06.08.2017 in connection with Forbesganj P.S. Case No. 606/2017 registered for the offences punishable under Sections 461/379 of the Indian Penal Code. Later on, Section 411 of the Indian Penal Code was added.
Learned counsel for the petitioner submits that the First Information Report was lodged against the unknown persons but subsequently, during the course of investigation, the petitioner was taken into custody and after using coercive method, a confessional statement was extracted by the police which has got no evidentiary value. Learned counsel for the petitioner submits that an amount of Rs. 22,000/- along with a laptop was recovered
Patna High Court Cr.Misc. No.5688 of 2018 (2) dt.02-02-2018 2/2 from the house of the petitioner, but these items have not yet been put on T.I.P. It is further submitted that the petitioner has got no criminal antecedent.
Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 606/2017.
