2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-B)/26 and 35 of the Arms Act.
3.As per allegation in the FIR, during course of vehicle checking, police stopped a Bolero and apprehended six persons who were sitting inside. On search, pistols, cartridges and mobile phones were recovered from the accused persons. Allegedly, from possession of petitioner, one mobile was recovered.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No any
Patna High Court CR. MISC. No.73477 of 2024(2) dt.17-10-2024 2/2 arms were recovered from conscious possession of the Petitioner. After investigation, police has submitted chargesheet. Petitioner is languishing in judicial custody since 4.7.2024.
5. The application for bail is opposed by learned APP for the State and submitted that petitioner has got three criminal antecedents.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Buxar in connection with Rajpur P.S. Case No. 207 of 2024 subject to condition that petitioner shall co-operate in the trial and be present physically on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
