JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Kanti P.S. Case No.462 of 2019 registered under Sections 147, 149, 323, 324, 307, 504, 506 and 509 of the Indian Penal Code besides Sections 3/4 of the Prevention of Witches Practices Act, 1949. The accusation is that five persons, named in the F.I.R., including the petitioners variously armed with weapons, in the evening of 17.06.2019, came at the door of the informant Lalsa Devi and started to abuse denoting her witch. Patna High Court CR. MISC. No.64029 of 2019(2) dt.18-10-2019 2/2 gave 'Kata" at the head of Umesh Pandit, the husband of the informant, whereas petitioner no.2 gave axe blow to Umesh Pandit on his head. In that course, the petitioner no.3 caused assault to the brother-in-law of the informant through Daab. Others also caused injury to them.
Learned counsel for the petitioners submits that only one grievous injury was found on the person of the husband of the informant, which is attributed to the co-accused Jhulan Pandit and not the petitioners. The other injuries of the husband of the informant and her brother-in-law are simple in nature. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate (West) Muzaffarpur, in connection with Kanti P.S. Case No.462 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
