Petitioners apprehend their arrest in a case registered for the offence punishable under Section 323, 379, 420 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners cheated the complainant, abused him and also assaulted him with fists and slaps. They also threatened the complainant to shoot him. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Both parties are agnates and land dispute with regard

Learned counsel appearing for the State and the complainant opposed the prayer for anticipatory bail. It is submitted that petitioner claims that the land in question has been given to his maternal grandfather through deed by Namo Mahto but Namo Mahto died before the year 1908 and, therefore, he can not transfer the land in question to maternal grand father of the petitioner in the year 1908. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Begusarai in connection with Complaint case No. 1235C/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
