JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Special Case No. 9441 of 2017 arising out of Alamaganj P.S. Case No. 498 of 2017 registered under Section 30(a) of the Bihar Excise Act.

The accusation is that, on receiving secret information about selling of illicit liquor by the petitioner at his house situated at Arfabad Colony, the informant and other police official reached there. On search, 160 bottles each containing 600 ML, country made liquors were recovered from the house of the petitioner, from where, one person was apprehended, who disclosed the name

Patna High Court Cr.Misc. No.17232 of 2018 (2) dt.28-03-2018 one Karan Kumar and also disclosed that the seized liquor belonging to Rajesh Kumar @ Bilaila, which was kept by his friend, Viccu @ Vikash Kumar @ Viccu Kumar (petitioner). Learned counsel for the petitioner submits that petitioner was not apprehended at the spot at the time of recovery of alleged country made liquor. It is further submitted that petitioner has no criminal antecedent and is in custody since 22.12.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise at Patna, in connection with Special Case No. 9441 of 2017 arising out of Alamaganj P.S. Case No. 498 of 2017.
