The petitioner is accused in connection with Manihari P.S. Case No. 43 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 95 bottles, each containing 750 ML, 23 bottles, each containing 750 ML, 56 bottles, each containing 375 ML of India made foreign liquor kept in three cartons from the bush situated behind the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner, who is lady has falsely been implicated in this case. The alleged seized liquor has not been recovered from the house

Patna High Court Cr.Misc. No.17163 of 2018(2) dt.28-03-2018 2/2 of the petitioner rather the same has been recovered from bush. The petitioner has no criminal antecedent and she is in custody since 25.02.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge-II-cumSpecial Judge (Excise), Katihar, in connection with Manihari P.S. Case No. 43 of 2018.
