Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 354, 504, 506 and 302 of the Indian Penal Code. For land dispute, allegation is against eight named accused persons including the petitioners to have committed assault with lathi etc. to Ram Pravesh Sharma and the informant. Subsequently, Ram Pravesh Sharma died of injury. Submission of the learned counsel for the petitioner is that the allegation is not specific against the petitioner and single head injury was found which was cause of death. Learned counsel for the informant opposed the
Patna High Court Cr.Misc. No.54452 of 2017 (3) dt.02-01-2018 2/2 prayer for bail.
Considering the fact that there is no specific allegation against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mohiuddin Nagar Police Station Case No. 104 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
