The petitioner seeks regular bail in connection with Pirbahore P.S. Case No. 370 of 2022 registered for the offence under Sections 363, 363(A)/365 of the Indian Penal Code. As per prosecution case, the informant alleged that his daughter, aged about three years, was missing from home and when the informant made inquiry, it has come to know that his tenant Samir Khan took away his daughter on the allurement of giving biscuit and left her to beggar at platform no.10 at Patna Junction. After inspecting the CCTV footage, the involvement of the this petitioner has also been found.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has

It is further submitted vide para-8 of the petition that while the petitioner was returning from her village, she found a child in abandoned condition. She searched the parents of the child, on beggar claimed to be the parents of child but the child refused to identify the beggar then the petitioner took away her house, thereafter, police recovered the child from her house. The petitioner has no role in missing of child of informant. The petitioner is languishing in judicial custody since 9.7.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pirbahore P.S. Case No. 370 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Magistrate, Patna.
