The petitioner apprehends his arrest in connection with Kaler P.S. Case no. 26 of 2017, registered under Sections 406, 420 and 409/34 of the Indian Penal Code. The accusation is that 1328 quintal of rice from the BSFC godown under the conspiracy of Assistant Godown Manager and Chairman PACS has been theft.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, it has came in light that petitioner was one of the labourer, who put the bags of rice on the truck. The petitioner has no criminal antecedent.

Case No. 26 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
