JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2023 The present petition has been filed by the petitioner for extending the time granted to him for surrendering before the learned court below, vide order dated 28.7.2023, passed in Criminal Misc. No. 38514 of 2023.

The learned counsel for the petitioner has submitted that on account of communication gap, the petitioner could not surrender within the time frame prescribed by this Court by the aforesaid order dated 28.07.2023, hence, four weeks further time be granted for the purposes of surrendering before the Ld. Trial Court and being admitted to the privilege of anticipatory bail.

Having regard to the facts and circumstances of the case,

Patna High Court CR. MISC. No.71912 of 2023(2) dt.03-11-2023 2/2 considering the averments made in the present petition and taking into account the submissions of the learned counsel for the petitioner, I deem it fit and proper to extend the time granted to the petitioner, by this Court by an order dated 28.7.2023, by a further period of four weeks from today, for the purposes of surrendering before the learned Court of Exclusive Special Excise Court-2, Nawada, in connection with Excise P.S. Case No. 204 of 2023 and availing the privilege of anticipatory bail. 4.

The present petition stands disposed off with the aforesaid modification in the order dated 28.7.2023, passed in Criminal Miscellaneous No. 38514 of 2023.
