JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-01-2018 The petitioner seeks pre-arrest bail in connection with Chauradano P.S. Case No. Case No. 152 of 2017, dated 21.06.2017, instituted for the offences punishable under Sections 147, 148, 149, 323, 332, 427, 353, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Bihar Prevention of Defacement of Property (Amendment) Act, 2010.

The petitioner and many others are alleged to have staged a protest in the Block Office and are also stated to have indulged in destruction of the Government property.

Patna High Court Cr.Misc. No.56705 of 2017 (3) dt.19-01-2018 2/2 Learned Counsel, appearing on behalf of the petitioner, has submitted that since the petitioner had taken upon himself to give vent to the grievances of the people of the area, he has been singled out by the informant and the present case has been lodged. Though the petitioner has been named in the First Information Report, but nothing specific has been alleged against him, so far as the allegation of destruction of Government property is concerned. In the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below, within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, East Chmparan at Motihari, in connection with Chauradano P.S. Case No. Case No. 152 of 2017.
