The petitioner seeks bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 154 of 2017 registered under Sections 420, 379 of the Indian Penal Code. The petitioner is said to have illegally withdrawn Rs. 40,000/- from the account of the informant to whom the informant had given his ATM card to withdraw Rs. 4,000/- on his behalf.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to ulterior motive. He has not withdrawn any money from the

Patna High Court Cr.Misc. No.12833 of 2018(3) dt.04-04-2018 2/2 account of the informant. He was not identified in the CCTV footage installed in the ATM Kiosk. Though, the petitioner has been remanded in more three cases, but he is on bail in the aforesaid cases. He has been languishing in custody since 2.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 154 of 2017.
