This application for regular bail arises out of Sarsi P.S. Case No. 163 of 2018, disclosing the offence under Section 392 of the Indian Penal Code.

It is alleged in the First Information Report that the miscreants snatched petitioner's Mobile phone and some cash. The First Information Report was lodged against four unknown persons. The petitioner's name has surfaced on the basis of confessional statement of co-accused Santosh Kumar Mandal. Learned counsel for the petitioner has submitted that said Santosh Kumar Mandal has been allowed regular bail by this Court by an order dated 32463 of 2019 passed in Cr. Misc.

It appears that the petitioner is accused in other cases also registered for the offences punishable under Section 392 of the Indian Penal Code, as stated in paragraph-3 of the application. It is, however, the case of the petitioner that he has been allowed regular bail by the court below in those cases. Considering the facts and circumstances and keeping in mind the fact that the person on whose confessional statement the petitioner has been implicated, has been allowed regular bail, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea, in connection with Sarsi P.S. Case No. 163 of 2018, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
