2. The petitioner seeks bail in connection with Jadopur P.S. Case No. 165 of 2024 registered for the offence under Sections 109, 124(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner is accused of throwing acid on his cousin brother in which the victim got 40 percent burn injury and during the course of treatment, he died.

4. The petitioner is in custody since 5.11.2024.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and the victim has died after more than nine months from the date of occurrence.

6. Learned counsel for the informant has opposed the application of the petitioner and he submits that the petitioner is also accused of throwing acid on his own brother also and for the same offence, one case has also been registered against the petitioner.

7. Considering the fact that the petitioner is accused of killing the deceased by throwing acid upon him, this Court is not inclined to grant bail to the petitioner.
