Learned counsel for the petitioner is expected to honour his undertaking to remove the defects as pointed out by the office when called upon to do so by the office. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Complaint Case No. 1268 of 2017, Trial No. 3282 of 2017 instituted for the offence under Sections 498A, 354, 324, 494, 504/34 of the Indian Penal Code and section 3⁄4 of the D.P. Act. As per complaint petition, petitioner, who is husband of complainant, and his family members have harassed the
Patna High Court CR. MISC. No.71354 of 2019(8) dt.30-11-2021 2/3 complainant due to non-fulfillment of further dowry demand. He has also performed second marriage.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the informant and has been falsely implicated in this case. He has never demanded anything to his wife. Petitioner is ready to keep his wife with full honour and dignity.
Learned APP appearing for the State as well as learned counsel appearing for the informant have asserted that inspite of second marriage made by the petitioner with another lady, the complainant, namely, Salma Praveen is ready to live with his husband and petitioner is also ready to keep his wife with full honour and dignity.
Having heard learned counsel for the parties and considering the submission made on behalf of the petitioner, this Court is inclined to enlarge him on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Complaint Case No. 1268 of 2017, Trial No. 3282 of 2017 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya
Patna High Court CR. MISC. No.71354 of 2019(8) dt.30-11-2021 3/3 subject to the conditions as laid down under section 438(2) of the Cr.P.C.
However, petitioner is directed to remain present with his wife at the time of filing of the bail bond and both will assert before the court below that they are ready to lead the conjugal life happily.
