ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.11.2017 in connection with Gaunaha P.S. Case No.111 of 2017 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 332, 333, 307, 436, 395, 427, 353, 151, 152, 153, 187, 188, 189, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has been named in the F.I.R. along with around hundred people and his name has figured in the F.I.R. at Serial No.5. It is further submitted that no specific allegation has been
Patna High Court Cr.Misc. No.11682 of 2018 (2) dt.08-03-2018 2/2 attributed to the present petitioner and he is a poor man having small shop of quilt and pillow. It is further submitted that only on the basis of the identification by the local Chaukidar, his name has been figured in the F.I.R.
Taking into consideration the entire facts and circumstances of the case and that save and except one case under the Excise Act, the petitioner is having no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bettiah, DistrictWest Chamaparn, in connection with Gaunaha P.S. Case No.111 of 2017.
