Petitioner seeks regular bail in connection with Banka P.S. Case No.446 of 2019, for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2016. The allegation against the petitioner is that a total quantity of about 18 litres of illicit liquor has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case inasmuch as the seizure list was not prepared in terms of Section 100 of the Cr.P.C. Learned counsel further submits that the house from where the illicit liquor has been recovered is joint family property and only the petitioner has been implicated in this case.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 13.07.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd, Banka, in connection with Banka P.S. Case No.446 of 2019.
