Petitioners, already in custody, seek bail in connection with Bahera PS Case No.235 of 2017, registered under Sections 447, 341, 323, 324, 307, 379, 504, 302 and 34 of the Indian Penal Code.

Allegation in brief is that accused persons assaulted elder brother and father of the informant, the specific accusation of assaulting the brother of the informant is against Shrawan Kumar Yadav and Shyam Yadav is said to have assaulted the father of the informant over his head, Vinod Yadav is said to have assaulted the father of the petitioner with farsa and rest others assaulted with lathi and danda.

Patna High Court Cr.Misc. No.23797 of 2018(2) dt.20-04-2018 2/2 Learned counsel for the petitioners submits that there is no specific overt act alleged against these two petitioners, there is land dispute between both sides, similarly situated accused Kalbindar Yadav has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.47308 of 2017 on 16.10.2017 and the petitioners are in custody since 04.12.2017.

Having considered the aforesaid facts and circumstances, petitioners, namely, Ajay Yadav @ Ajesh Yadav @ Ajesh Kumar Yadav and Nunu Yadav @ Chandan Kumar Yadav are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Benipur, Darbhanga in connection with Bahera PS Case No.235 of 2017.
